Bye, Bye Miss Zaadz Pie, Drove my Poetry to the GAIA...

.... but the GAIA was dry.
Or at least profitable.
It appears my good friend Sings to Eagles and I quickly noted a similar statement in The Terms of Use.
Is it not curious that POETS quickly notice something like this?
In short, here is my concern. I do not expect to profit from the poetry which I channel. I have provided it to this community since I do not feel that I "own" the poetry, that I am blessed with a gift and wish to share that gift with others. The zaadz community seemed a superb, non-threatening, and not-driven-by-profit venue to share this poetry.
Yet, it seems, GAIAM, at least in reading the terms of use, leaves a foothold to usurp "intellectual property."
11. License to Your Content. By posting, displaying, publishing, transmitting, or otherwise making available (individually and collectively, "posting") any Content on or through our Websites or the Service, you hereby grant to Gaiam a non-exclusive, fully-paid, royalty-free, perpetual, irrevocable, worldwide license (with the right to sublicense through unlimited levels of sublicensees) to use, copy, modify, adapt, translate, create derivative works, publicly perform, publicly display, store, reproduce, transmit, distribute, and otherwise make available such Content on and through our Websites, in print, or in any other format or media now known or hereafter invented, without notification, compensation, or attribution to you, and without your consent. The bold is my highlight. Read it closely, and perhaps you will understand my concern. I do not even consider my poetry - my soul, as it were - MINE. I consider it ours. Yet, GAIA can "use, copy, modify, adapt, translate, create derivative works" of it? GAIA has a free license to it?
I think not.
Some of the very work posted in my blog and in the pods has been published. I worked out where NO changes would be made, and on one even insisted the poem be under "anonymous." Any future publishings have to receive my permission. Further, I did not profit from the publishing - "payment" was donated back to the non-profit organization that publishes the magazine in which the work was published.
See the difference? If GAIA wishes to remain the free-spirit site that was known as zaadz, this term of use for much of the artistic expression that has thrived on zaadz needs to cease immediately!
I will give the GAIA administrators some time to ponder these "terms of service." If, within a month, this "license to content" is not modified to provide provisions for "intellectual property" and works of artistic expression, I shall find another venue.

I too will watch this closly, thank you so much for taking the time to find and post about it. I certainly don't my artwork want taken and used anyway they see fit without asking first. What the Hell? I will be stopping all my art for the day's here then, and take down my gallery of original art. And I was having such a nice day.
I am so sorry this news has nixed such a nice day. Yet, there are so many artists here, I think this is important. Please, help spread the word. I think the administrators are very balanced, and with enough concern, there is possibility for the “terms” to be constructed in such a way to allow artistic expression to continue florishing with allowing those who channel the artistic expression to have a vote as to how it is reproduced.
I had no idea, how shady! Hopefully Sionna will chyme in.

Well, that will teach me to not pay attention. I suppose this has been going on since January 8, at the discussion Re: Terms of Service Issues .
Here is what I posted there:

Incredibly pertinent, and wish I had found it before.
Unless the “”Zaadz claims no ownership over any Content submitted, posted or displayed by you on or through the Website. You or a third party licensor, as appropriate, retain all patent, copyright, and trademark rights to any Content you submit, post or display on or through the Website and you are responsible for protecting those rights, as appropriate” is added back in, I will “perpetually and irrevocably” depart GAIA. This departure would be one of the more tragic separations in my life.
No, this is not a “I'm taking my toys and going home,” as will be evidenced in the copied section below.
Rather, this is a “I had confidence in the above Zaadz disclaimer, but have no confidence in the Terms as currently outlined.”
I fervently meditate, hope, pray, and positively project that the “no ownership” clause will be added - for spiritual reasons.”

Weep with me, a time for tears
I want to reiterate something I've been posting today…. “we are not trying to scam any of our members” … Siona is actively working with the legal people to iron out the details of HOW the terms should be worded for our community. It is vastly different than most communities… and we, the team, are poignantly aware of that… and our intent for continuing to create the most amazing online social networking site is still intact. We didn't want to delay the launch because of the terms, so we proceeded with the utmost confidence that we will get this wording fixed. And as most people know, dealing with multiple people in communications takes time; especially on these terms.
Yes, we are very concerned for our members rights and are still focused on the integrity with which the site was founded and further grown. Please hold that perspective as your focus… for as we all know…. “where awareness goes, energy flows” … let's manifest the positive results that we want out of this situation. Yes, be vocal about what you want - but please don't abandon ship without giving due time to correct the things you are asking about.
Please be patient with us. We are diligently working for you.

I was in the same delima, until I came up with a solution. Why not simply write a blog entry, but put a “LINK” in your blog to your poems?
Create your own personal blog somewhere else, with wordpress (very easy), like what I've done, and then put all your poems and such on there.
that way, you are protected: and its just a link to YOUR content…
I've been told to create a book with my poems, and make money off it, but I don't want to do that either. I write for myself and for the world if they can benifit from it.
